A patent confers the right to exclude others from making, using, offering for sale, or selling the invention in the United States or importing the invention into the United States. Generally, a utility patent has a lifespan of 20 years from the date of filing a utility patent application. A design patent has a fourteen14-year lifespan from the date of issuance. A U.S. patent is effective only within the United States. Foreign patents must be obtained to enforce rights in other countries.
