Giroux Amburn, P.C.

An appellate attorney is essential to preserve a trial victory, or to overturn an adverse judgment or conviction.

An appellate attorney can lay the groundwork for a successful trial, or bring a successful resolution without ever having to have a trial.

Appellate litigation demands a thorough understanding of the law; the intellectual acuity and experienced eye to identify a winning issue; the ability to craft a readily-understood, succinct and credible brief; and the ability to persuade a panel of judges to find in your favor.

Appellate Services Include:

  • Briefing and arguing appeals
  • General advice on appellate matters
  • Post-judgment motions
  • Amicus briefs
  • Unwinding default judgments
  • Moot courts
  • Motions/applications for rehearing or reconsideration
  • Appellate motions practice
  • Ensuring errors at trial are preserved for appeal

Giroux Amburn’s appellate practice is led by Matthew Klakulak who has handled more than sixty appeals to the Michigan Court of Appeals, Michigan Supreme Court, the United States Court of Appeals for the Sixth Circuit and other appellate courts. He has extensive experience in briefing and arguing dispositive motions in both state and federal trial courts. Many of these cases have involved extremely complex, research-intensive issues and multi-million dollar injuries and jury verdicts. Issues addressed involved personal injury, governmental immunity, medical malpractice, insurance coverage, vicarious liability, employment law, criminal defense, and many others.

Mr. Klakulak’s experience and the Giroux Amburn’s research resources provide the ability to handle a broad range of appeals expeditiously. This depth of resources is especially important in light of Michigan state court’s new “fast track” appeals (where the appeal is from a grant or denial of summary disposition) in the Court of Appeals, in which the time allowed for preparation and filing of a brief is reduced to one-quarter of the normal length.

Mr. Klakulak can take the lead on appeals or dispositive motions from law firms that may wish to allocate its litigating attorney resources elsewhere or lack the specialized experience Mr. Klakulak offers. Mr. Klakulak is also available to consult on other firm’s appeals. Flexible fee structuring or engagement arrangements are available.
